1. SCOPE

This Privacy Policy explains how ACE MD collects, uses, discloses, and protects information when you:

  1. Visit ACE MD websites or pages that link to this Privacy Policy.
  2. Use ACE MD online forms, intake flows, and portals that link to this Privacy Policy.
  3. Communicate with ACE MD by email, text, chat, or phone in connection with ACE MD services.

This Privacy Policy does not replace notices issued by medical providers, pharmacies, or laboratories that deliver clinical services or dispensing services. Those entities may provide separate notices that govern protected health information.

2. DEFINITIONS

Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to you or your household.

Sensitive Personal Information may include government identifiers, account credentials, precise geolocation, and certain health related data, as defined by applicable law.

Protected Health Information, also called PHI, generally means health information protected by HIPAA when handled by a covered entity or business associate in connection with treatment, payment, or healthcare operations.

Consumer Health Data is a term used in some state laws and can include health related information and inferences, including information that indicates interest in or use of health related services.

De-Identified Information means information that cannot reasonably be used to infer information about, or otherwise be linked to, an identifiable individual, as defined by applicable law.

3. INFORMATION ACE MD COLLECTS

ACE MD collects information in three ways: information you provide, information collected automatically, and information received from third parties.

A. Information you provide

ACE MD may collect:

  1. Contact and account information, such as name, email address, phone number, mailing address, date of birth, and account credentials.
  2. Intake and assessment information, such as health history, symptoms, goals, allergies, medications, and other information submitted through forms or portals.
  3. Communications, such as messages, support requests, and chat content.
  4. Transaction and fulfillment information, such as order history, subscription status, shipping address, and order status.
  5. Payment information. Payment card data is typically processed by a payment processor. ACE MD may receive limited payment related details such as billing address and payment confirmation.
  6. Identity verification and fraud prevention information, where used for compliance, safety, and fraud prevention. This may include government issued identification or verification results from service providers.
  7. Content you submit, such as files or images you voluntarily provide.

B. Information collected automatically

When you visit ACE MD websites or use ACE MD online services, ACE MD may collect:

  1. Device and browser information, such as IP address, device identifiers, device type, operating system, browser type, language, and settings.
  2. Usage information, such as pages viewed, time spent, clicks, referring pages, and navigation paths.
  3. Approximate location, such as general location inferred from IP address.
  4. Cookies and similar technology information described in Section 7.

C. Information received from third parties

ACE MD may receive information from:

  1. Licensed clinicians or medical provider entities involved in evaluating eligibility and providing care.
  2. Pharmacies involved in dispensing and shipping prescriptions.
  3. Laboratories and testing partners, if lab work is ordered or coordinated.
  4. Service providers that support payments, identity verification, communications, hosting, analytics, and security.
  5. Advertising and marketing partners that provide measurement tools, subject to Section 7 and applicable opt out rights.

6. HEALTH INFORMATION, TELEHEALTH, AND HIPAA

ACE MD supports telehealth workflows through licensed clinicians and prescription fulfillment through pharmacy partners.

A. When HIPAA or other health privacy rules may apply

Certain information may be PHI and may be governed by HIPAA or other applicable health privacy laws when handled by covered entities or business associates in connection with treatment, payment, or healthcare operations.

B. When this Privacy Policy applies

Information that is not intended and used solely for diagnosis, treatment, prescribing, dispensing, or related healthcare operations may not be PHI. For example, general browsing data on marketing pages and certain account setup information may be governed by this Privacy Policy and applicable state privacy laws.

C. Marketing and health information

ACE MD does not use PHI for advertising or marketing where prohibited by law. ACE MD may send service related communications necessary to provide services, including administrative, security, and transactional messages.

5. HOW ACE MD USES INFORMATION

ACE MD uses information to:

  1. Provide services, including intake, eligibility evaluation, care coordination, prescription fulfillment, shipping, and support.
  2. Operate and maintain the platform, including account creation, authentication, troubleshooting, and service continuity.
  3. Communicate with you, including confirmations, support responses, shipping updates, and administrative notices.
  4. Process transactions, including billing, subscription administration, and customer service.
  5. Protect safety and integrity, including fraud prevention, identity verification, security monitoring, and enforcing terms and policies.
  6. Improve services, including analytics, quality assurance, and user experience optimization.
  7. Conduct marketing activities where permitted by law, and measure marketing performance.
  8. Create and use De-Identified Information for analytics, reporting, service improvement, and other purposes permitted by law.

9. HOW ACE MD DISCLOSES INFORMATION

ACE MD discloses information as described below.

A. Disclosures to provide services

ACE MD may disclose information to:

  1. Licensed clinicians and medical provider entities to review intake information and provide care.
  2. Pharmacies to dispense and ship prescriptions.
  3. Laboratories and testing partners when lab work is ordered or coordinated.
  4. Communications providers that deliver email, text, or other service messages.
  5. Customer support providers that assist with service operations.
  6. Payment processors and financial institutions to process payments and reduce fraud.
  7. Shipping and logistics providers to deliver products.

B. Disclosures for business operations

ACE MD may disclose information to vendors that provide:

  1. Hosting, storage, and infrastructure.
  2. Security and fraud prevention.
  3. Identity verification.
  4. Analytics and performance measurement.
  5. Legal, compliance, and auditing support.

C. Advertising and analytics disclosures

ACE MD may allow certain analytics and advertising partners to collect information through cookies and similar technologies. Some state laws define certain disclosures used for targeted advertising as "sale" or "sharing." Section 11 describes opt out options where required by law.

D. Disclosures for legal and safety reasons

ACE MD may disclose information to comply with applicable law or legal process, respond to lawful requests, protect rights and safety, and enforce agreements.

E. Business transfers

If ACE MD is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed or transferred as part of that transaction, subject to applicable law and appropriate safeguards.

7. COOKIES, DEVICE IDENTIFIERS, AND SIMILAR TECHNOLOGIES

A. What these technologies are

ACE MD and service providers may use cookies, pixels, web beacons, scripts, SDKs, and similar technologies.

  1. Cookies are small files stored on your device that allow a website to recognize a browser over time.
  2. Pixels and web beacons are small images or code that can transmit information when a page or email is viewed.
  3. Mobile advertising and analytics IDs are identifiers provided by mobile operating systems that can be used similarly to cookies.

B. How ACE MD uses them

ACE MD uses these technologies to:

  1. Operate the website and keep sessions secure.
  2. Remember preferences and reduce repeated entry of information.
  3. Understand site usage and performance.
  4. Measure marketing performance and support interest based advertising where permitted.
  5. Detect fraud and protect platform integrity.

C. Your choices

You can control certain technologies through:

  1. Browser settings to block or delete cookies.
  2. Mobile device settings to limit ad tracking or reset advertising IDs.
  3. Email client settings to prevent automatic downloading of images, which can reduce email tracking technologies.
  4. Any cookie preference tool ACE MD makes available, if enabled.

Disabling cookies may limit site functionality.

D. Global Privacy Control

Some browsers support Global Privacy Control. Where required by applicable law and technically feasible, ACE MD will treat a recognized Global Privacy Control signal as a request to opt out of processing for targeted advertising and related disclosures that may be considered "sale" or "sharing" under certain state laws.

E. Do Not Track

Because there is no consistent industry standard for interpreting Do Not Track signals, ACE MD does not currently respond to Do Not Track browser signals.

8. COMMUNICATIONS PREFERENCES

A. Email

You can opt out of promotional emails by using the unsubscribe mechanism in the email. ACE MD may still send service and transactional emails.

B. Text messages

If ACE MD offers SMS messages, you can opt out by following the instructions in the message, including replying STOP where applicable. Carrier message and data rates may apply.

C. Service messages

Certain messages are necessary to provide services, including security and administrative notifications.

9. DATA RETENTION

ACE MD retains information for as long as reasonably necessary to:

  1. Provide services you request.
  2. Maintain business and operational records.
  3. Meet legal, regulatory, compliance, and tax obligations.
  4. Resolve disputes and enforce agreements.
  5. Maintain clinical and pharmacy related documentation where required.

Retention periods vary based on data type, purpose, user expectations, and legal requirements.

10. SECURITY

ACE MD uses administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, and destruction.

No method of transmission or storage is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.

11. PRIVACY RIGHTS AND REQUESTS

Privacy rights vary by state. Depending on where you live and the services you use, you may have the right to:

  1. Access and obtain a copy of Personal Information.
  2. Correct inaccurate Personal Information.
  3. Delete Personal Information, subject to legal exceptions.
  4. Obtain a portable copy of certain Personal Information.
  5. Opt out of processing for targeted advertising.
  6. Opt out of certain disclosures that may be considered "sale" or "sharing" under applicable state laws.
  7. Limit certain uses and disclosures of Sensitive Personal Information where applicable.
  8. Appeal certain decisions on privacy requests where required.

A. How to submit a request

Submit requests to the ACE MD Privacy Officer using the contact information at the top of this policy.

B. Verification

ACE MD verifies identity before fulfilling certain requests. Verification may include account authentication, matching information provided to information on file, and in some cases requesting additional proof of identity.

C. Authorized agents

Where permitted by law, an authorized agent may submit a request on your behalf. ACE MD may require proof of authorization and may require you to verify identity directly.

D. Appeals

Where required by law, submit an appeal by contacting the Privacy Officer and using the subject line "Privacy Request Appeal."

12. CALIFORNIA DISCLOSURES

If California law applies, the following may also apply.

A. Categories of Personal Information collected

Depending on your interactions, ACE MD may collect:

  1. Identifiers, such as name, email, phone, address, and IP address.
  2. Customer records, such as account and subscription information.
  3. Commercial information, such as transaction history.
  4. Internet or network activity, such as browsing and usage data.
  5. Geolocation data, generally approximate location inferred from IP address.
  6. Sensitive Personal Information, which may include health related information and account credentials.
  7. Inferences drawn from usage to personalize experiences.

B. Do Not Sell or Share

ACE MD provides opt out mechanisms for certain disclosures used for targeted advertising that may be considered "sale" or "sharing" under California law. Requests can be submitted to the Privacy Officer. Where recognized by law and technically feasible, a Global Privacy Control signal may be treated as an opt out request as described in Section 7.

C. Shine the Light

ACE MD does not disclose Personal Information to third parties for the third parties' direct marketing purposes as defined by California Civil Code section 1798.83.

13. CONSUMER HEALTH DATA

Some state laws regulate Consumer Health Data.

A. Categories

Consumer Health Data may include:

  1. Intake details and health information you submit through forms or portals.
  2. Information about treatments or services you view or request.
  3. Inferences drawn from interactions with health related pages or services.

B. Purposes

ACE MD uses Consumer Health Data to provide services, facilitate clinician review, coordinate pharmacy fulfillment, support customer service, prevent fraud, and operate and improve the platform.

C. Disclosures

ACE MD discloses Consumer Health Data to clinicians, pharmacies, laboratories, and service providers as described in Section 6. Where required by law, ACE MD provides rights and opt out mechanisms related to targeted advertising and certain disclosures.

D. Requests

Where applicable, you may have rights to access, delete, or withdraw consent related to Consumer Health Data. Submit requests as described in Section 11.

14. CHILDREN AND MINORS

ACE MD services are intended for adults age 18 and older. If you believe a child provided information, contact the Privacy Officer.

15. THIRD PARTY WEBSITES AND SERVICES

ACE MD websites may link to third party websites or services. Third parties control their own privacy practices. This Privacy Policy does not apply to third party practices.

16. INTERNATIONAL USERS

ACE MD services are intended for use in the United States. ACE MD may process and store information in the United States, subject to U.S. law.

17. CHANGES TO THIS PRIVACY POLICY

ACE MD may update this Privacy Policy. ACE MD will update the "Last Updated" date when changes go into effect.
